The Police Complaints Authority (PCA) is seeking a suitably qualified individual to fill
the position of Legal Counsel II.
LEGAL COUNSEL II
ROLE PROFILE
Provide high quality, efficient, effective and confidential legal service as required for
the investigation of criminal offences involving police officers, police corruption,
serious police misconduct and related matters in accordance with the PCA Act 2006.
Follow-up/liaise with the Director of Public Prosecutions/Police Service
Commission/Commissioner of Police/other stakeholders. Provide sound
counsel/requisite assistance in the execution of the overall functions of the PCA in
order to detect/reduce/prevent serious police misconduct, police corruption and
related matters. Perform related legal services, duties and relief as required.
CORE RESPONSIBILITIES:
STRATEGIC RESULTS & INTERNAL OPERATIONS
• Interpret legislation/provide legal advice to the PCA on matters related to its
functions and activities, including the material content of any complaint
• Review investigations monitored by the PCA in relation to any criminal offence
involving police officers, police corruption/serious police misconduct
• Recommend inquiries into/audits of any aspect of police activity to ascertain
whether there is police corruption/serious police misconduct
• Draft/vet/execute legal documents/contracts and agreements/ MOUs for working
effectively with co-operating Agencies
• Record/maintain proper custody of files, evidence and information
• Analyse evidence gathered to determine admissibility in the prosecution of, or
disciplinary proceedings against any person/make suitable recommendations
• Recommend/develop policy for the revision and amendment of legislation
governing the PCA and the operations of the PCA
• Provide guidance on the execution of tasks/conduct of investigations within the
PCA Act, building rules of engagement for the Investigations Department
• Research/analyse relevant/potential legal issues
• Follow to ensure proper closure of investigations
• Follow to ensure effective Case Management and the quarterly review of
active/cold case files to determine strategy and action required
• Recommend to the PCA, methods, strategies and procedures for the elimination
of police corruption and serious police misconduct
• Attend court and other hearings as required
• Provide specialist advice and knowledge
• Complete reports and administrative requirements
SERVICE NETWORKING & STAKEHOLDER RELATIONS
• Provide courteous, efficient, confidential service taking appropriate action for
effective resolution of complaints
• Liaise/follow/work with stakeholders on legal matters, lending expertise
/building relationships as authorised/appropriate
• Represent the PCA at Legislation Review Committee/appointed Committees
• Participate in consultations/negotiations with proposed suppliers/service
providers/consultants to the PCA
• Adopt a problem solving approach to issues
• Participate in hearings/case conferences/meetings as required
• Foster good community and positive public relations
• Project a favourable and professional image promoting respect for PCA
RISK CONTROL & MANAGEMENT
• Follow all standard operating procedures
• Review standard operating procedures and policies to ensure that these are in
compliance with the PCA Act/laws of T&T and that the chain of evidence is
preserved
• Assist in ensuring that the PCA is compliant with all statutory/regulatory
requirements
• Maintain Confidentiality
• Maintain professional practice standards at all times
HR TEAM BUILDING & EMPLOYEE RELATIONS
• Facilitate/actively participate in training, the transfer of knowledge and best
practice to enhance performance
• Assist in the conduct of training needs analysis/identify necessary training
requirements for the PCA
• Co-operate/work closely with management and staff for the overall success of
PCA
• Ensure connectivity and integrated functioning to increase successful outcomes
• Actively participate in meetings and briefings
• Set an excellent example
MINIMUM QUALIFICATIONS AND EXPERIENCE
• Minimum of a Bachelor of Laws(LLB) and Legal Education Certificate (LEC)
• Admission to practice as an Attorney-At-Law in the T&T jurisdiction
• Minimum of 4 years experience as a practicing Attorney at Law with:
o Sound knowledge and understanding of the Police Complaints Authority
Act 2006, the Police Service Act and Regulations,
o Domestic Violence Act, the legal framework and scope of operation under
which PCA operates and the implications of key legal issues on operations
and functions
o Sound knowledge of criminal law and of relevant legislature governing
Trinidad and Tobago
o Good knowledge of the operations of the Trinidad and Tobago Police
Service
